What to do when a tenant's rent cheque bounces in the UAE
A returned rent cheque is stressful for the landlord and awkward for the agency. Since 2 January 2022, a cheque that bounces only for lack of funds is no longer a criminal matter by default in the UAE: it is handled through civil enforcement, and the returned cheque itself can be executed. Here is what a property manager should record and do, in order. This is general information, not legal advice: check with a lawyer before you start proceedings.
1. Record it the same day
- Mark the cheque Bounced in your register, with the date and the return reason written on the bank's return memo (for example insufficient funds, signature mismatch, account closed).
- Keep the original cheque and the return memo together. You need both for any enforcement.
- Tell the landlord the same day: cheque number, amount, reason, and what you plan to do next.
2. Check whether part of the amount was paid
Under the Commercial Transactions Law (Federal Decree‑Law No. 50 of 2022, Article 648), when the drawer's account holds some but not all of the amount, the bank pays the available balance unless the holder refuses it, records the partial payment on the cheque and gives the holder the original cheque and a certificate of payment. The register should show the amount received and the balance still due, not just "bounced".
3. Ask the tenant to replace it
Most returned rent cheques are settled without any proceedings. Contact the tenant promptly, in writing, and agree how the amount will be paid: a new cheque, a bank transfer or another method the landlord accepts. When it arrives:
- Record the replacement and link it to the bounced cheque, so the landlord statement shows the rent once.
- Mark the original as Replaced only when the replacement has cleared, not when it is promised.
- Return or retain the original cheque as agreed with the landlord, and note it in the register.
4. If the tenant does not pay: two separate routes
Collecting the cheque and ending the tenancy are different matters. Landlords often pursue both, with their lawyer.
Collecting the cheque amount
Under Article 667 of the same law, a cheque on which the drawee bank has noted that funds are unavailable or insufficient is an executive instrument: the holder can ask the execution judge to enforce it, in full or for the unpaid balance, without first winning a civil case. In Dubai, rent cheques are enforced through the Rental Disputes Center service File an Execution – Cheques. It asks for the lease (Ejari), the ID or trade licence of the claimant, a bank letter showing the claimant's IBAN, a copy of the dishonoured cheque and the bank's return memo, with documents in or legally translated into Arabic.
Ending the tenancy for non‑payment
In Dubai, Law No. 26 of 2007 (Article 25(1)(a)) allows the landlord to seek eviction before the lease ends if the tenant fails to pay the rent, or any part of it, within 30 days of being served a notice to pay. The bounced cheque is evidence of non‑payment; the eviction claim is filed separately at the Rental Disputes Center. Other emirates have their own tenancy laws and rental committees, so confirm the procedure where the property is located.
5. Keep the landlord statement right
Until the money is in, the bounced amount should appear as outstanding, not as rent received. When it is paid, by replacement or execution, it should appear once. This is where spreadsheets most often go wrong; see how to track post‑dated rent cheques.
Questions property managers ask
Is a bounced rent cheque still a crime in the UAE?
Not by default. Since 2 January 2022, a cheque returned only for insufficient funds is handled through civil enforcement. Criminal penalties remain for bad-faith cases set out in the law, such as closing the account or withdrawing the balance to stop payment.
Can a landlord recover a bounced rent cheque without a court case?
Yes. Under Article 667 of Federal Decree-Law No. 50 of 2022, a cheque returned for unavailable or insufficient funds is an executive instrument, so the holder can apply directly to the execution judge. In Dubai, rent cheques go through the Rental Disputes Center service File an Execution - Cheques.
Does a bounced cheque allow the landlord to evict the tenant in Dubai?
Not by itself. Under Article 25(1)(a) of Dubai Law No. 26 of 2007, the landlord can seek eviction if the tenant does not pay within 30 days of a notice to pay. That claim is separate from collecting the cheque.
What documents should we keep after a rent cheque bounces?
The original cheque, the bank's return memo, the lease (Ejari), any partial payment certificate from the bank, and a written record of messages with the tenant about the replacement.
